In Azerbaijan, trademarks are registered by the Intellectual Property Agency. This body reviews applications, maintains the state trademark register, and ensures trademark protection. The examination is carried out by the Agency's Patent and Trademark Examination Center.
How long does it take, and who can apply?
- Registration under the accelerated procedure takes approximately 3–4 months (may be longer under the regular procedure).
- Local individuals and companies can apply directly.
- Foreign individuals and companies can only apply through a registered patent attorney – an important detail for brands from Turkey or other countries.
- The application is submitted in Azerbaijani, with a clear representation of the trademark and a list of goods/services (Nice Classification).
- Registration is valid for 10 years and can be renewed.
Why is this critical for franchising?
Franchising is essentially the lease of three things: the trademark, the know-how (business knowledge), and trade secrets. The most visible of these is the trademark.
- If you are a franchisor: if your trademark is not registered, you cannot legally grant it. Without registration, someone else can copy your name, and you cannot stop them.
